1. Introduction

These Terms of Service ("Terms") govern your use of MyBnB.nz website and services, as well as the booking and use of accommodations offered through MyBnB.nz. By accessing our website, making a booking, or staying at one of our properties, you agree to be bound by these Terms.

Please read these Terms carefully before making a booking. If you do not agree with any part of these Terms, please do not use our services or make a booking.

2. Definitions

In these Terms, the following definitions apply:

• "We," "us," "our," and "MyBnB.nz" refer to MyBnB.nz, the provider of the accommodation services described on this website.
• "You," "your," and "guest" refer to the person making a booking, as well as all persons who will be staying at the property under that booking.
• "Property" refers to any accommodation listed on MyBnB.nz that is available for booking.
• "Booking" refers to the reservation of a property for a specified period.

3. Bookings & Payments

3.1 Booking Process

All bookings must be made by persons over 18 years of age. By making a booking, you warrant that you are over 18 years of age and have the legal capacity to enter into binding agreements.

3.2 Booking Confirmation

A booking is not confirmed until you receive a written confirmation from us, and the required deposit or full payment has been received.

3.3 Payments

Payment terms are as follows:

• A 25% deposit is required at the time of booking to secure your reservation.
• The remaining balance is due 30 days prior to your check-in date.
• For bookings made less than 30 days before the check-in date, full payment is required at the time of booking.
• A security deposit may be required for some properties, which will be returned within 7 days of check-out, provided no damages or additional charges have been incurred.

3.4 Pricing

All prices are in New Zealand Dollars (NZD) for New Zealand properties and Australian Dollars (AUD) for Australian properties, inclusive of GST. Prices may change at any time, but changes will not affect confirmed bookings where a deposit has been paid.

4. Cancellations & Refunds

4.1 Cancellation by You

Cancellation policies are as follows:

• Cancellations made 30 days or more before check-in: Full refund minus a 10% administrative fee.
• Cancellations made 14-29 days before check-in: 50% refund of the total booking amount.
• Cancellations made less than 14 days before check-in: No refund.

All cancellations must be made in writing via email to [email protected].

4.2 Cancellation by Us

In rare circumstances, we may need to cancel your booking due to unforeseen circumstances, such as property damage, safety concerns, or force majeure events. In such cases, we will offer you:

• A full refund of all payments made; or
• Alternative accommodation of similar or higher standard, if available.

We will not be liable for any additional expenses incurred as a result of such cancellations.

4.3 Changes to Bookings

Changes to booking dates are subject to availability and may incur additional charges. Any changes must be requested in writing at least 14 days before the original check-in date.

5. Check-In & Check-Out

5.1 Check-In Time

Standard check-in time is 2:00 PM. Early check-in may be available upon request but cannot be guaranteed.

5.2 Check-Out Time

Standard check-out time is 10:00 AM. Late check-out may be available upon request but cannot be guaranteed and may incur additional charges.

5.3 Key Collection

Details for key collection will be provided in your booking confirmation. It is your responsibility to ensure you have these details before arrival.

6. Property Use

6.1 Maximum Occupancy

The number of guests staying at the property must not exceed the maximum occupancy stated in the property listing. Additional guests may result in termination of the booking without refund.

6.2 Property Rules

You agree to abide by any specific rules for the property, which will be provided in your booking confirmation or at the property. These may include rules regarding:

• Noise restrictions
• Smoking policy
• Pet policy
• Waste disposal
• Use of amenities

6.3 Respectful Use

You agree to use the property respectfully and to leave it in a similar condition to how you found it. Excessive cleaning required after your stay may incur additional charges.

6.4 No Parties or Events

Unless specifically agreed in writing, parties, events, or functions are not permitted at our properties. Violation of this policy may result in immediate termination of your stay without refund and additional charges for any disturbance or damage caused.

7. Damages & Liabilities

7.1 Property Damage

You are responsible for any damage to the property, its contents, or any adjacent property caused by you or any member of your party during your stay. Any damages must be reported immediately.

7.2 Security Deposit

The security deposit, if required, will be used to cover any damages or additional cleaning required. If the cost of damages exceeds the security deposit, you agree to pay the additional amount.

7.3 Liability Limitations

We are not liable for:

• Any loss or damage to your personal belongings during your stay
• Any injury or illness that occurs during your stay, except where caused by our negligence
• Any disruption to your stay caused by factors beyond our reasonable control

We recommend that you have appropriate travel insurance to cover your stay.

8. Privacy Policy

We respect your privacy and are committed to protecting your personal information. Our Privacy Policy, which forms part of these Terms, explains how we collect, use, and safeguard your information.

By making a booking, you consent to the collection and use of your personal information as described in our Privacy Policy.

9. Amendments

We reserve the right to amend these Terms at any time. The version of the Terms that applies to your booking is the version that was in effect at the time your booking was confirmed.

For ongoing use of our website and services, the current version of the Terms will apply.
